Litigation is when formalized pleadings are prepared on a client’s behalf and submitted to the court for consideration. The parties and their attorneys appear before a judge or commissioner at an appointed time and place. Sometimes testimony of the parties or third party witnesses is taken. The parties argue different facts and points of law. At the conclusion of the hearing or trial, the judicial officer will make a ruling on the issues before him or her.
